Multi-Million-Dollar Verdict Hits Florida Developer for His Scheme to Defraud Subway Founder in Massive Land Project

West Palm Beach, FL—Jurors Friday cleared Subway founder Fred DeLuca of responsibility for the alleged breach of a massive land development agreement, and they handed down a to-be-trebled $2.9 million verdict against his partners, a Florida real estate developer and his business manager, for their role in a scheme to defraud DeLuca. Update: Doctor Prevails in $5M Fraud, Med Mal Trial Over Patient's Hysterectomy

Update: Dr. Magdi Hanafi, the gynecologist that performed a 2007 hysterectomy on Tammy Toomer, prevailed Monday evening in Toomer's suit claiming Hanafi forged her signature on consent forms and negligently performed the procedure.

Jurors deliberated for four hours before clearing Hanafi on claims ranging from medical malpractice to fraud. The decision capped a week-long trial and followed a closing in which Toomer's attorneys requested up to $5 million, plus attorney fees in the case. 

CVN will publish video of the trial as soon as it is available.

Fraud Claim Adds $350K to Plaintiff's Recovery in Major Commercial Breach-of-Contract Case

A plaintiff normally cannot recover damages for fraud in a breach of contract action, but, in a recent major commercial case, a successful plaintiff was able to add nearly $350,000 to its eventual recovery by successfully adding and proving a fraud count to its original complaint, based on information the defendant revealed for the first time during discovery.
