Marietta, GA--Life expectancy played a central role in last week's trial on damages for the catastrophic brain injury Ehsan Khan, 57, suffered in a 2013 tractor-trailer crash. Khan's attorneys, including Fried Rogers Goldberg's Joe Fried, sought nearly $25 million in damages, including more than $3.6 million for future medical expenses, based on Khan's life expectancy. However, attorneys for trucking firm Moore Freight Service, Inc. and driver John Teal argued damages should be reduced because the crash had significantly shortened Khan's life.

GA Supreme Court's Reversal of $4M Asbestos Verdict May Make Cases Harder to Prove

The Georgia Supreme Court’s reversal this month of a $4+ million asbestos verdict clarified the law of causation in asbestos exposure cases, limiting expert testimony on the issue. The ruling potentially makes cases harder to prove by requiring plaintiffs show evidence a defendant’s asbestos was at least a “meaningful contributing factor” to a plaintiff’s overall exposure. Scapa Dryer Fabrics, Inc. v. Expert Says Infection, Not Negligence, Killed Hospital Patient, as Med Mal Trial Continues

"No matter what was the cause of [Harper's] respiratory arrest, that was treated, he recovered, and he went steadily downhill after that. And that was a result of the infection," infectious disease specialist Dr. Daniel Musher says Monday in the trial of two doctors who treated Kenneth Harper before his death.


Atlanta—An infectious disease expert told jurors Monday that a hospital patient likely died from infection that overwhelmed his suppressed immune system, and not medical error, as trial entered its second week against two doctors who treated him. Harper v. Vick, et al., 08EV005552.
