Last month Courtroom View Network and TBI Med Legal presented a webinar featuring two of the nation’s foremost trial experts analyzing real courtroom video from a $16.4 million slip and fall case against Lowe’s, and that webinar is now available for free on-demand viewing via CVN.

Trial consultant David Ball and attorney Sean Claggett spent nearly 3 hours analyzing video clips from the trial filmed by CVN and answering questions from a massive online audience of attorneys. If you didn’t have time to take advantage of this rare and valuable educational opportunity as a live viewer, you can now watch (or rewatch!) this unique webinar from the convenience of your home or office.

Sean contrasts his performance in this 2016 trial with the style he has evolved to employ today, and David gives practical, actionable tips on how to present these complex and sometimes emotionally fraught brain injury cases to a jury.

The trial in question took place in Las Vegas in 2016, when jurors concluded negligence by retail giant Lowe’s caused plaintiff Kelly Hendrickson to slip and fall in standing water on the floor of the store's garden department as she was looking at palm trees. Hendrickson, whose head struck the concrete in the fall, permanently lost her senses of taste and smell among other injuries.

At trial Claggett successfully argued Hendrickson she didn't see a caution cone warning of spillage while the store watered the area's plants, and she claims the company failed to do enough to protect its patrons from falls.

Lowe’s, represented by defense powerhouse Lewis Brisbois Bisgaard & Smith LLP, argued to jurors that a reasonable person should expect water in the garden area of a home improvement store, and that prudent steps were taken like putting down orange safety cones to warn customers.

Sean Claggett, of the Claggett & Sykes Law Firm, was recently recognized as the 2017 Nevada Trial Attorney of the Year by the Nevada Justice Association. A top expert in the use of pre-trial focus groups, Claggett has obtained numerous multi-million verdicts in range of practice areas, including multiple trials involving TBI-related injuries.

Dr. David Ball, a litigation researcher and strategist with North Carolina’s Malekpour & Ball Consulting (JuryWatch, Inc.) is the author of numerous landmark trial strategy books, including the best-selling David Ball on Damages and Theater Tips & Strategies for Jury Trials. He is the preeminent trial strategist practicing today, and David Ball on Damages is today considered mandatory reading for both new and veteran trial attorneys.

CVN has more exciting webinars planned for October, including an all-star panel of nationally respected product liability plaintiff attorneys breaking down a historic $150 million verdict in the first trial involving an allegedly defective Jeep gas tank, and a webinar featuring two winners of the highly-coveted CAALA Trial Lawyer of the Year award breaking down video clips involving California trial maverick Steve Vartazarian.
