Gene Odom tells jurors in openings that a delay in getting his client, Brittany Falkner, emergency care following an ATV accident led to her permanent brain and back injuries. Falkner is suing the driver of the ATV, Edward Murawski, for more than $100 million.

Judge Peter Dubensky declared a mistrial Tuesday in Dupre v. R.J. Reynolds after plaintiffs' attorneys failed to disclose a change in the testimony of Kevin Dupre, the son of Richard Dupre, whose 1994 death from artery disease launched the Engle suit against R.J.
