The trial in question took place in Las Vegas in 2016, when jurors concluded negligence by retail giant Lowe’s caused plaintiff Kelly Hendrickson to slip and fall in standing water on the floor of the store's garden department as she was looking at palm trees. Hendrickson, whose head struck the concrete in the fall, permanently lost her senses of taste and smell among other injuries.

At trial Claggett successfully argued Hendrickson she didn't see a caution cone warning of spillage while the store watered the area's plants, and she claims the company failed to do enough to protect its patrons from falls.

Lowe’s, represented by defense powerhouse Lewis Brisbois Bisgaard & Smith LLP, argued to jurors that a reasonable person should expect water in the garden area of a home improvement store, and that prudent steps were taken like putting down orange safety cones to warn customers.
