On Thursday, September 17 at 2pm Eastern/11am Pacific, TBI Med Legal and Courtroom View Network will present a free webinar featuring heavyweight trial specialist Sean Claggett and legendary trial consultant Dr. David Ball analyzing real courtroom video from a slip-and-fall TBI case against Lowe’s ending in a $16.4 million verdict.
Part of CVN and TBI Med Legal’s ongoing “TBI Trial Video Deep Dive” series, this webinar will offer the valuable opportunity to learn firsthand from a plaintiff’s attorney with a national reputation for taking difficult cases to verdicts far surpassing settlement offers and from one of the most respected trial consultants practicing today specializing in “reptile theory” - a trial presentation technique that encourages jurors to envision themselves in the same situation as a plaintiff.

Sean will curate numerous CVN video clips from key moments in the trial, and then he and Dr. Ball will use the video to both show and tell participants how to more effectively present these difficult and often complex TBI cases to jurors with the greatest impact. There will also be ample time for Q&A from the audience.
The trial in question took place in Las Vegas in 2016, when jurors concluded negligence by retail giant Lowe’s caused plaintiff Kelly Hendrickson to slip and fall in standing water on the floor of the store's garden department as she was looking at palm trees. Hendrickson, whose head struck the concrete in the fall, permanently lost her senses of taste and smell among other injuries.
At trial Claggett successfully argued Hendrickson she didn't see a caution cone warning of spillage while the store watered the area's plants, and she claims the company failed to do enough to protect its patrons from falls.
Lowe’s, represented by defense powerhouse Lewis Brisbois Bisgaard & Smith LLP, argued to jurors that a reasonable person should expect water in the garden area of a home improvement store, and that prudent steps were taken like putting down orange safety cones to warn customers.
