Potentially $100M suit against security company settles during jury deliberations

Why you should watch: The family of a motorcyclist who crashed into a turning armored truck struck a settlement in 2019 with security company GardaWorld shortly after a Texas state court jury began deliberations in a trial that could have resulted in a $100 million verdict.

The confidential settlement was disclosed a day after jurors heard closing arguments accusing Garda, a Canadian-based company with over 200 offices worldwide, of being responsible for the death of Virgilio Martinez Garcia in 2018.

Garcia was riding alongside and slightly behind a Garda truck that suddenly attempted to make a left turn from the far right lane. He slammed into the side of the truck and died at the scene.

Ploetz v. National Collegiate Athletic Association

NCAA settles football brain injury lawsuit on 3rd day of historic trial

Why you should watch: The NCAA reached a settlement in 2018 in Texas state court with the widow of a college football player who suffered from a brain disease linked to repeated concussions, bringing the much anticipated first-in-the-nation trial to an abrupt end.

Judge Kenneth Molberg dismissed the jury three days after opening statements took place in what was the first trial ever in a lawsuit seeking to hold the NCAA responsible for a college football player’s chronic traumatic encephalopathy, or CTE.

Why you should watch: “Plaintiff filed his lawsuit seeking damages against Southeastern and its driver as a result of the accident. Plaintiff alleged that Southeastern’s driver, Josh Tatum, made an improper lane change and struck his vehicle, totaling his vehicle. Plaintiff sought damages for his injuries including, pain and suffering in the past and future, and medical expenses in the past and future. In Plaintiff’s initial pleading, Plaintiff sought damages in excess of one million dollars.”

Frausto, et al. v. Pennsylvania Rehab LP, et al.  

Jury clears nursing home, hospital over refusal to place mentally ill bedsore patient on ventilator

Why you should watch: A Texas state court jury found in 2016 that a hospital acted properly by following instructions in a mentally ill woman’s do-not-resuscitate order that her children claim she couldn’t have knowingly signed, when the hospital refused to place her on a ventilator after she developed pneumonia.

The jury returned the verdict on December 16, the morning after hearing closing arguments in a trial that began on December 5. The panel rejected allegations from the adult children of Diane Rimert that she developed bedsores due to supposedly negligent treatment received at the Pennsylvania Rehabilitation LP nursing home in Fort Worth, or that Texas Health Harris Methodist Hospital should have made greater efforts to prolong her life.

Why you should watch: A Texas state court jury in 2016 rejected a lawsuit against a demolition company brought by the family of a construction worker killed in a roof collapse during the demolition of an elementary school building, finding that the company wasn’t grossly negligent and the worker failed to follow standard safety procedures.
