Woman Hit By Amazon Delivery Van Awarded $5M By California Jury

San Bernardino, CA - A California state court jury has awarded $5 million to a woman run over by an Amazon delivery van in a parking lot, and the full trial was recorded gavel-to-gavel by Courtroom View Network.

The San Bernardino County jury returned the verdict on June 8th following a trial that began on May 25th. The trial dealt solely with the amount of damages owed to plaintiff Anita Sun Eisenberg, after Amazon admitted liability for the 2018 accident that left her with injuries to her left leg.

The award comes to less than the $24 million sought by Eisenberg’s attorneys and also more than the $1.3 million Amazon argued would amount to fair compensation.

Eisenberg’s attorneys told the jury she suffered a severe crush injury to her leg, injuries to her neck and back, and a subsequent condition known as Complex Regional Pain Syndrome, or CRPS. However Amazon argued that while the company agreed Eisenberg sustained a serious injury to her ankle and leg they disputed her claim of having CRPS in addition to the severity of her other alleged injuries.

Eisenberg, 43, works as an entrepreneur and beauty aesthetician. Shortly before the accident she appeared on the popular reality television show Shark Tank, and the jury saw a clip of her presentation on the program. 

After the trial attorney Justin Strassburg of Strassburg Gilmore & Wei LLP, who represented Eisenberg, told CVN that the trial took place without a high-low agreement in place, and that he did not anticipate Amazon seeking an appeal of the verdict.

An attorney for Amazon did not respond to a request for comment.
