Trial Set to Start Against Atlanta Hotel Over Claims Falling Pipe Left Taxi Driver With Brain Damage

Decatur, GA— Trial is set to begin next week over the brain damage a taxi driver claims he suffered when he was hit by a pipe that fell from a rooftop pool deck at the Crowne Plaza Hotel Atlanta Midtown. Laguerre v Peachtree Property Sub LLC, et al., 17A64087.

According to documents filed in the case, Max Laguerre contends he was waiting at the taxi stand of Midtown Atlanta’s Crowne Plaza Hotel in March 2015 when a pipe fell from the fourth floor rooftop pool area and struck his head.

The pipe fell while the pool area was undergoing renovations. Laguerre, who contends he suffered a traumatic brain injury from the impact, claims the hotel owners and the project's general contractor, Cajun Contractors Inc., are responsible for not taking appropriate safety precautions.  

According to court records, both the hotel and Cajun deny liability, arguing the pipe fell because of work performed by a subcontractor who is not a party to the case.

Laguerre is represented by Bethany Schneider, of Schneider Law, and Quynh-Huong Nguyen Davis, of Davis Injury Law.

The hotel owners, including Peachtree Property Sub LLC and AWH Partners LLC, are represented by Hall Booth Smith’s R. David Ware and Pearson Cunningham.

Cajun is represented by Tony Jones, Todd LaDouceur, and Casey Smartt, of Galloway, Johnson, Tompkins, Burr & Smith.

Trial, before DeKalb County State Court Judge Dax Lopez, is expected to last about 4 days.
