Trial to Begin Against FedEx Over Fatal Crash | CVN to Stream Proceedings

Jacksonville, FL— Jury selection is underway this week in a trial against FedEx Ground Package System and others over a 2017 Florida crash that killed an 18-year-old woman and injured her two passengers.  Marcus, et al. v. NKM Transportation, et al., 2018-CA-004903. 

According to court records, Sari Marcus, 18, was killed, while her 2-year-old daughter and another passenger were injured in the wreck after Marcus swerved to avoid a head-on collision with another car.

Charles Marcus III, Sari Marcus’s husband, filed suit on behalf of Marcus's estate and the couple's child. He claims the crash was caused by an improperly parked FedEx truck, contracted through NKM Transportation and driven by NKM employee Jerry Mondestin, which forced traffic to navigate around it and into the lane in which Sari Marcus was traveling. 

According to court filings, the defense contends that the truck was reasonably parked under the circumstances. And they claim Marcus was speeding at the time, while the driver of the oncoming vehicle unsafely attempted to pass the truck.

The trial is a hybrid proceeding with jury selection conducted this week remotely via Zoom. Trial is scheduled to open in person on Monday.
