Florida Jury Rejects $14M Lawsuit Over Triple Car Crash

A Florida state court jury returned a defense verdict in May in a lawsuit stemming from a three-car pileup. Plaintiffs Charles and Deborah Carey, in addition to another driver Peter Lafroscia, sued defendant Sanjeet Gupta in 2022 after he collided with both of their vehicles. They sought more than $14 million in damages, but the defense successfully argued that despite speeding at the time Gupta didn’t cause the collision but was instead cut off by Lafroscia.

Georgia Jury Awards $18.3M in Med Mal Trial Over Patient's Ultimately Fatal Post-Op Heart Attack

Last July a Georgia jury handed down an $18.3 million verdict against two physicians for the ultimately fatal heart attack a Georgia man suffered after undergoing surgery. The Gwinnett County (Georgia) State Court jury deliberated for roughly four hours before reaching its verdict at trial over the 2019 death of Ron Yarbrough, then 64. Yarbrough died a little over a month after suffering a heart attack while recovering from non-emergency colon surgery. Yarbrough’s family contends the surgeon that performed the procedure, Dr. Kota Venkatesh, and Yarbrough’s long-time cardiologist, Dr. Lance Friedland, are responsible, because they allegedly failed to properly address signs that Yarbrough may have suffered from critical heart issues.
Missouri Jury Clears Surgeon At Trial Over Hip Implant Failure

A Missouri state court jury returned a defense verdict in April favor of an orthopedist who faced accusations of not disclosing a bone fracture to a patient after hip replacement surgery. The St. Louis County jury returned their verdict on April 11 shortly after hearing closing arguments in a four day trial. Plaintiff Sunie Lasky blamed Dr. Christopher Mudd of Orthopedic Associates LLC for allegedly not telling her about a post-surgical fracture while still prescribing physical therapy, but the defense successfully argued the conservative course of treatment Dr. Mudd prescribed for an unconfirmed fracture was consistent with the standard of care.
PREMISES LIABILITY TRIALS
These trials often don’t make headlines without a massive verdict and are rarely covered gavel-to-gavel by anyone besides CVN, but to insurers and industries ranging from hospitality to retail premises liability claims can have substantial impact on business practices.
Las Vegas Jury Awards $15M For Casino Slip-and-Fall

A Nevada state court jury awarded $15 million in April to a woman who sustained serious leg injuries when she slipped on a spilled drink in a Las Vegas casino. Plaintiff Debbie Fenton alleges she developed a chronic debilitating condition called Complex Regional Pain Syndrome after falling at a private event held at The Cosmopolitan Hotel Las Vegas in 2021. The Cosmopolitan argued the organization that leased the party space was responsible for maintaining it during the event, and that the fall happened just moments after the spill without a reasonable amount of time to clean it up. However the jury rejected those arguments on April 7 and awarded Fenton roughly $1 million in past and future medical expenses and roughly $14 million for past and future pain and suffering in April to a woman who sustained serious leg injuries when she slipped on a spilled drink in a Las Vegas casino
Florida Jury Rejects $17.8M Vacation Resort Premises Liability Lawsuit

A Florida state court jury returned a defense verdict last June in a lawsuit filed by a woman claiming she suffered a serious foot injury after tripping outside the parking garage at a vacation resort. The Okaloosa County jury reached their verdict on June 26 shortly after hearing closing arguments in the three-day trial. Attorneys for plaintiff Emily Webre sought between $13.75 million and $17.87 million for foot injuries they say were caused by an unmarked cement step that violated the local building code, but the defense successfully argued Webre’s flip-flop shoes and alleged intoxication caused the accident, along with maintaining the step didn’t create a dangerous condition.
TALC AND ASBESTOS CASES

$20M Verdict Hits J&J in Talc Trial Over Florida Doctor's Death

Last October jurors handed down a $20 million verdict against Johnson & Johnson after finding the company’s talc-based Baby Powder caused a Florida doctor’s death. The jury, in Florida’s 17th Circuit, wrapped a roughly six-week trial by finding J&J liable on design and manufacturing defect claims related to the 2019 mesothelioma death of Dr. Alberto Casaretto, Sr., 79. Casaretto, a South Florida nephrologist for much of his life, had used Johnson & Johnson’s Baby Powder and Shower to Shower products for years. His family contends that asbestos in the talc J&J used in those products caused his mesothelioma, a fatal cancer that develops in the lining of the lungs.
Jurors Find Asbestos in Brake Dust Caused Woman's Cancer, Maker of Brake Grinder Liable for $2.7M of $18M Verdict
Last March a Florida jury concluded asbestos in brake dust was a cause of a woman’s cancer, rendering the maker of a brake grinder liable for $2.7 million of the total $18 million verdict jurors handed down. The verdict, reached by the 17th Circuit (Florida) state court jury, in Broward County, found Hennessy Industries, the lone defendant at trial, 15% responsible for the mesothelioma Denise Cook, 64, developed. Cook says she developed the cancer after years of exposure to asbestos in dust from work her family did on car brakes.
